Terms of Service
TERM. Upon acceptance of either Gold Star Scoopers’ online Quote, services will continue indefinitely on a recurring basis until cancelled in accordance with these Terms of Service.
CANCELLATION. Clients may cancel services at any time for any reason without penalty. Cancellations apply to future billing periods only; payments already collected are non-refundable except in cases of billing error. To cancel, please call Gold Star Scoopers, email us at support@goldstarscoopers.com, or use the cancellation link in your Customer Account online. Payment for services already rendered remains due at time of cancellation.
FEE PAYMENT. All services are prepaid.
The initial cleanup fee will be charged at the time of signup, prior to the first service. If recurring service is scheduled to begin within the same calendar month, a pro-rated subscription fee will also be charged based on the selected service frequency and the number of days remaining in that month. If recurring service is scheduled to begin the following month, the client will be billed on the 1st of that month.
Ongoing subscription payments are collected automatically on a monthly basis, according to the service interval and rate selected by the client at the time of service acceptance.
If selected, additional services (such as deodorizing or waste haul-away) will be performed during the initial cleanup and prorated accordingly for the remainder of the first month. These services are billed per cleanup and included in the client’s monthly invoice moving forward. Applicable sales tax may be added where required by law.
Clients are responsible for any reasonable collection costs, including attorney’s fees, incurred by Gold Star Scoopers in recovering overdue balances.
PAYMENT METHOD. Clients must provide valid credit card information at signup. This will be stored securely and used for recurring monthly payments. If a payment fails and is not corrected within ten (10) business days after notice, Gold Star Scoopers reserves the right to suspend or terminate services. Additional fees may apply for failed transactions or reinstatement.
CONSENT TO CONTACT. By providing your contact information, you consent to receiving calls, text messages, and emails from Gold Star Scoopers and its affiliates, including automated or pre-recorded messages, for service and billing-related matters.
ELECTRONIC COMMUNICATIONS. With your permission, we may send account documents (notices, records, etc.) electronically instead of paper. This does not mean all communications will be electronic, but it allows us to send them in that format when appropriate.
REFUNDS. Refunds are only issued in the event of a billing error on our part. In other situations, refunds are issued minus payment processing fees and any applicable proration. Credits may be issued on a case-by-case basis and applied to future invoices.
SATISFACTION GUARANTEE. If you're not satisfied with a service, we’ll do our best to return the same day. Requests must be made within 24 hours of service; after that, work is considered final.
MODIFICATIONS. Changes to services or terms will be provided in writing. Price changes require 30 days’ notice. Additional charges may apply for modified services.
SERVICE HOURS. We operate from sunup to sundown and in most weather conditions. Unsafe conditions (e.g., storms, extreme heat/cold) may delay service. Clients will be notified. Routes and service days may be adjusted at our discretion. Prices reflect closures on the following holidays: New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving and the Friday after, and Christmas week. Service may also be paused due to inclement weather, government orders, or acts of God, but charges may still apply unless paused or cancelled by the client.
ACCESS. Ensure gates are accessible and clear. If we can’t access the yard, the visit will still be charged. Clients should confirm gates are secured post-service.
AGGRESSIVE ANIMALS. We do not service yards with aggressive pets present. If a service provider cannot safely enter the yard due to an animal, the visit will still be charged. If an employee is bitten, they will seek immediate medical attention and leave the property; the visit will be considered complete. Clients are responsible for medical expenses and may be required to provide proof of vaccinations. Gold Star Scoopers reserves the right to decline service for safety concerns.
INSURANCE. Gold Star Scoopers carries all legally required local/state/federal licenses and at least $1,000,000 in general liability insurance.
FORCE MAJEURE. Delays caused by events beyond our control (weather, government action, etc.) do not void the agreement. Services may be postponed or cancelled at our discretion. Missed services do not constitute abandonment.
INDEPENDENT OPERATOR. Gold Star Scoopers L.L.C. is a locally owned and operated independent business. We are not affiliated with any national franchisor or brand. All service obligations are solely ours.
SEVERABILITY. If any part of these Terms is ruled invalid, the rest remains enforceable.
DISPUTES. This agreement is governed by the laws of the state in which Gold Star Scoopers operates. Any disputes not resolved directly may proceed to mediation and, if necessary, arbitration under the American Arbitration Association. Collection efforts are excluded from this requirement. Clients are responsible for all legal fees related to collection. CLIENT WAIVES RIGHTS TO A JURY TRIAL.
LIQUIDATED DAMAGES. In the event of a breach, Gold Star Scoopers may retain any payments made as liquidated damages, not as a penalty.
NO WAIVER. Acceptance of partial payments or failure to enforce terms does not waive our rights.
ENTIRE AGREEMENT. These Terms represent the full agreement between the client and Gold Star Scoopers L.L.C. Oral agreements are not part of these Terms.
